Acceptance of terms

By creating an account or using èKeto, you accept these terms. If you do not accept them, do not use the service. Mandatory consumer-protection rules always remain applicable.

Service description

èKeto is a service that provides informational estimates about whether food and products fit a ketogenic diet. The basic features are free; some advanced features require the Premium subscription described in its own section. Main features include:

• Analysis of product-label and fresh-food photos, barcode lookup, and a keto score from 0 to 100.
• Detected ingredients, estimated net carbs, warnings, alternatives, and compatibility with optional preferences.
• History, recipes, shopping list, daily goal, consumption logging, and weekly insights.
• History export, operational notifications, and profile-data management.

Premium subscription

Without a subscription you can create an account, analyze photos and labels, look up products by barcode, and view the keto score, ingredients, warnings, history, and recipes, within a daily analysis limit. The Premium subscription unlocks:

• Pantry.
• Shopping list.
• Daily net-carb goal.
• Saving analysis photos.
• A higher daily analysis limit.

Premium is an auto-renewable subscription available as a monthly or annual plan. It may include a free trial, when offered. The price, period length, and any trial are shown in the store before purchase.

• Purchase, payment, and billing are handled by Apple (App Store) or Google (Google Play), which sell the subscription and charge it to your store account.
• The subscription renews automatically for the same period, at the price shown in the store, until you cancel it. A free trial, if any, converts to a paid subscription unless cancelled at least 24 hours before it ends on the App Store, or before it ends on Google Play.
• App Store: you can cancel in Settings > your name > Subscriptions. To avoid renewal, cancel at least 24 hours before the end of the current period.
• Google Play: you can cancel in the Play Store app, under Profile > Payments & subscriptions > Subscriptions, or at play.google.com/store/account/subscriptions, at any time before the renewal date.
• After cancellation, Premium stays active until the end of the period already paid or of the current trial; it then does not renew and there are no further charges.
• Deleting your èKeto account does not cancel the store subscription: to avoid further charges, cancel it in the store.

Right of withdrawal (Articles 52-59 of the Italian Consumer Code). The seller of the subscription is Apple Distribution International Ltd. (App Store) or Google Commerce Limited (Google Play), depending on the store you used: withdrawal and refunds are requested from them. If you are a consumer, you may withdraw within 14 days of entering into the initial contract, without giving any reason and at no cost; any more favourable period offered by the store remains available. How to do it:

• App Store: open reportaproblem.apple.com, sign in with your Apple ID, choose "Request a refund", select the èKeto subscription, and state that you are exercising your right of withdrawal. https://reportaproblem.apple.com
• Google Play: open your order history, select the èKeto purchase, and choose "Request a refund" or "Report a problem", stating that you are exercising your right of withdrawal. https://play.google.com/store/account/orderhistory
• Google Play, alternatively: the instructions and refund form in the Google Play help center. https://support.google.com/googleplay/answer/2479637
• You may use the model withdrawal form (Annex I, Part B, of the Italian Consumer Code) or any unequivocal statement: sending it to the store within the 14 days is enough. If you have trouble, write to us and we will help. [email protected]

Exceptions. Premium is a subscription service, not digital content supplied once: the exclusion for digital content (Article 59(1)(o)) does not apply. The right is lost only if the service has been fully performed after you expressly asked for it to start immediately and acknowledged that you would lose the right of withdrawal (Article 59(1)(a)). The èKeto app does not ask you to waive it, so activating Premium does not make you lose the right. If you asked for the service to start immediately and withdraw within the 14 days, you may have to pay only for the part of the service already supplied (Article 57(3)). The seller refunds the amount due within 14 days of your notice, using the original payment method unless otherwise agreed. Cancelling renewal is different from withdrawal. This does not affect the mandatory rights granted to consumers by law.

Cancelling renewal alone keeps Premium active until the end of the period already paid. If a withdrawal or a refund results in the subscription being revoked, Premium ends when the revocation takes effect. After expiry, the free features remain available. Data you already entered stays in your account and becomes usable again with a new subscription.

Minimum age and account

You must be at least 16 years old and use a valid email address. You must provide accurate data, keep credentials confidential, and notify us about unauthorized access. You may not share, sell, or transfer the account.

AI limitations and user responsibility

Analyses are automated estimates based on images, text, and user-provided information. They may be incomplete, outdated, or wrong. Always check the original label, ingredients, nutrition facts, portions, and manufacturer warnings. Do not consume a product based only on an èKeto result, especially if you have allergies or intolerances.

Acceptable use

• Do not use the service for illegal, fraudulent, deceptive, or dangerous purposes.
• Do not upload malware or unlawful, offensive, or rights-infringing images or text.
• Do not attempt unauthorized access, bypass technical limits, or interfere with the service.
• Do not automate requests, extract data, or abuse APIs without written authorization.
• Do not create multiple accounts to evade suspensions or security controls.

Uploaded content

You retain ownership of photos, notes, and other content you upload. You grant us a limited, non-exclusive, royalty-free license to host it, process it with the providers listed in the Privacy Policy, and show you the results solely to deliver the service. You must have the right to use uploaded content and must not submit third-party personal data without a valid basis.

Account deletion and suspension

You can permanently delete your account from the app settings. This removes the account, analyses, saved photos, recipes, preferences, goals, consumption entries, notifications, shopping list, sessions, and device tokens, except data we must retain by law or temporary backup copies. We may suspend or close accounts used in breach of these terms, subject to applicable law.

Availability and service changes

The service is provided as available and may undergo maintenance, interruptions, or changes. We may add, change, or remove features, giving reasonable notice when a change materially affects users. We do not guarantee uninterrupted availability or absolute absence of errors.

Intellectual property

The èKeto brand, design, software, and materials belong to the controller or their respective licensors. You may not copy, modify, distribute, or commercially use them without permission, except as allowed by law. Photographed brands and labels remain the property of their owners.

Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential damage, temporary downtime, data loss not caused by willful misconduct or gross negligence, or decisions based on an automated estimate. Nothing in these terms limits liability that cannot legally be excluded or mandatory consumer rights.

Privacy and cookies

Personal-data processing is described in the Privacy Policy. Website cookie use is described in the Cookie Policy. Both form an integral part of these terms.

Changes to these terms

We may update these terms when the service or law changes. Material changes will be announced in the app or on the website, by email, or by push notification and, where appropriate, at least 30 days in advance. Continued use after the effective date constitutes acceptance to the extent permitted by law.

Governing law and disputes

These terms are governed by Italian law. We will first attempt an amicable resolution. Consumers may bring claims before the court of their residence or domicile as provided by applicable law, and all mandatory remedies remain available.
